My children didn’t choose to be part of a legal fight. They wake up every day to uncertainty, not knowing whether they will have a safe path to school or if their home will be dismantled because of a conflict that began before they were even born. This petition is not about me—it is about their right to grow up in peace, with stability, and with the same respect for justice that every child deserves.

As a father and as a resident who has built a life on this land, I cannot wait decades while my children suffer cold mornings, and I live under constant legal threats. This is not a fight over luxury—this is a plea for fairness and urgent justice.

This conflict began with hope and ended in fear. When I bought the land, I envisioned a peaceful life, raising my children close to nature. I respected the law, built a home, and contributed to the area. I worked hard to build 13 structures, develop the terrain, and raise animals. For years, no one objected.
The sudden reversal in 2024 has disrupted everything. From friendly handshakes and verbal agreements to threats of arrest, deportation, and total loss, my family now lives in constant anxiety. I am caught in a legal vacuum, where local enforcement appears biased and higher institutions are too slow to act.
This is a plea for timely justice. I am not demanding money. I am demanding to be heard and treated fairly before irreversible harm is done to my children, our home, and our lives.
Sept 2020: I purchased a 3,000 m² plot of land in Potrerillos, Mendoza from Luis Fontagnol. I paid an additional $2,000 specifically for private access to Ruta Nacional 7, and built my entrance gate (“tranquera”) at my own expense.
Aug 2022: I expanded my property by purchasing an additional 6,000 m² from the same seller.
2020–2024: I lived peacefully on the land, developed 13 buildings, and raised animals. The gate was used daily without any objections.
Aug 2024: Jessica Fontagnol appeared for the first time, claiming control of the land and demanding I stop using the gate.
Feb–June 2025: Tensions escalated. Jessica threatened legal and immigration action. A police officer, seemingly biased, ordered me to remove the gate under threat of arrest.
Present Day: My children’s daily well-being is at risk. Legal delays may take decades. I ask for urgent judicial attention—not financial help, but timely justice.
In September 2020, I purchased a rural plot in Potrerillos (Mendoza) from Luis Fontagnol. The contract described the land as having “access to Ruta Nacional 7.” Before signing, I was shown one plot, but after transferring the money, I was given a different one. Still, I agreed, as I have already done the paperwork and paid the bank transfer and legal fees.
Luis Fontagnol explicitly said that I could build my own gate facing the national road. This was part of the deal. I paid $12,500 total, including $2,000 for direct access. I installed a wooden gate on 30 September 2020 and used it daily for years without interference. No one from the Fontagnol family ever contested this gate or gave me access to any alternative entrance.
In August 2024, Jessica Fontagnol appeared and informed me I could no longer allow others through my gate. A few months later, she demanded that I remove my gate entirely and use a new “central access” that did not require use since the time of sale. She stated she was building a new street, but the contract I signed came before that plan.
In June 2025, I visited the local police station and was incorrectly told that the land bordering Ruta 7 is all government-owned up to 50 meters from the center, making my gate illegal. However, the law (Decree 505/1958) clearly states this limit is 35 meters. The original land survey was misaligned with the law, and if properly applied, my property should start 15 meters closer to the road.
The situation escalated when a police officer visited me, refused to hear my side, and threatened to arrest me if I didn’t remove my gate. Jessica stated—openly and in front of the officer—that if she files a complaint, I could be deported under new immigration laws.
All this, while I am the one who invested in, built, and maintained this land for 5 years. It is now valued at over $600,000 due to my work. The Fontagnol family offered to return an old motorhome and less than $800 in exchange for everything—an offer that feels not only insulting but coercive.
